LIMITED WARRANTY

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE. 

This limited warranty may also be found online at [www.nirvanaupfitters.com/warranty] and in the documentation we provide with the upfit.

We warrant that during the warranty period (as described below), the upfit will be free from defects in materials and workmanship.

To the extent not prohibited by law, this limited warranty is exclusive and in lieu of all other warranties, oral, written, statutory, express or implied. Except for the express warranties contained in this limited warranty statement and to the extent not prohibited by law, we disclaim all other warranties, expressed or implied, statutory or otherwise, including without limitation, the warranties of merchantability and fitness for a particular purpose. Some states do not allow disclaimers of implied warranties, so this disclaimer may not apply to you. To the extent such warranties cannot be disclaimed under the laws of your jurisdiction, we limit the duration and remedies of such warranties to the duration of this limited warranty.

Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

Our responsibility for defective goods is limited to repair or replacement as described below in this limited warranty statement. 

This limited warranty is valid only if the attached vehicle conversion warranty card is completed and return to us within thirty (30) days after the delivery date.

WHO MAY USE THIS LIMITED WARRANTY?

Nirvana Upfitters LLC located at address 106 Carter Street, Suite 303, Leominster, Massachusetts 01453 ("we" or “us”) extends this limited warranty only to the consumer who originally purchased the Upfit ("you"). It does not extend to any subsequent owner or other transferee of the Upfit.
 

WHAT DOES THIS LIMITED WARRANTY COVER?

This limited warranty covers defects in materials and workmanship of the converted van identified on the attached Vehicle Conversion Warranty Card (the "Upfit") for the Warranty Period as defined below.

WHAT DOES THIS LIMITED WARRANTY NOT COVER?

This limited warranty does not cover any damage due to: (a) transportation; (b) storage; (c) improper use, including without limitation, driving on unpaved roads and off-trail van use, excessive speed, stunts, reckless driving and driving under the influence; (d) failure to follow our recommendations, guidelines or instructions or to perform any preventive maintenance; (e) modifications; (f) unauthorized repair; (g) normal wear and tear; (h) natural aging or weatherization; (i) environmental conditions (including but not limited to airborne fallout, dust, chemicals, tree sap, salt, stones, insects, animals, and the application of chemical and sealants); (j) any accident, road hazard, off-road use, lack of proper maintenance, the replacement of maintenance items done in conjunction with normal maintenance services, failure to follow towing, hoisting and other operating instructions, fire, theft, vandalism, weather conditions (including hail, wind, lightning, snowfall, flooding; (k) anyone diagnosing, servicing, or using the Upfit and any of its components; (l) misuse of any plumbing or electrical components; (m) components made by other manufacturers; (n) unauthorized repairs or parts replaced by someone other than us; (o) components and materials installed by us that were provided by you; (p) components and materials installed by someone other than us; (q) external causes such as accidents, abuse, or other actions or events beyond our reasonable control or (r) labor fees incurred in the service or replacement of any manufactured product or component that are being warranteed through the manufcaturer.

This limited warranty is void if: (a) the Upfit has been maintained, modified or repaired by someone other than us or by a person not authorized by us to perform such maintenance or repair; or (b) the Upfit has been modified or altered in any respect from its original delivery condition without written authorization from us.

To the extent any vehicle, component, product or good installed by us includes any warranty from the manufacturer thereof, you agree that such manufacturer’s warranty shall be your sole recourse.  We reserved the right to bill you labor expenses necessary in the repair or replacement of good, product, or component being warranted through the manufacturer.

You understand that the Upfit may affect your ability to exercise any of your rights under any warranties you may have on your vehicle and components of your vehicle.
  

WHAT IS THE PERIOD OF COVERAGE?

This limited warranty starts on the date of your sale (as identified on the attached Vehicle Conversion Warranty Card) and lasts for two years from the delivery date or 18,000 miles from the odometer reading on the attached Vehicle Conversion Warranty Card, whichever occurs first (the "Warranty Period"). The Warranty Period is not extended if we repair or replace the Upfit. We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.
  

WHAT ARE YOUR REMEDIES UNDER THIS LIMITED WARRANTY?

With respect to any defective Upfit during the Warranty Period, we will, in our sole discretion, repair or replace the defective parts free of charge. You will responsible for all fees related to returning the vehicle with the Upfit back to us so that we may service and repair the Upfit. We reserve the right to request the return of any defective parts for inspection prior to paying warranty claims. We reserve the right to change specifications, materials, or equipment as necessary, to complete a warranty claim or service without incurring further obligations.
  

HOW DO YOU OBTAIN WARRANTY SERVICE?

To obtain warranty service, you must call (978)-798-3109 or email our Customer Service Department at info@nirvanaupfitters.com during the Warranty Period. To make a claim for warranty coverage under this limited warranty, you must contact us within thirty (30) days after you discover, or should have discovered, the damage or defect to request any warranty service prior to any work performed to repair the Upfit.
  

LIMITATION OF LIABILITY

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE UPFIT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
